Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the DayWise mobile application and website (collectively, the “Service”), operated by a sole developer based in South Africa (“we”, “our”, or “us”).

By downloading, installing, or using DayWise, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

DayWise is an AI-powered daily planning application for Android that helps individuals schedule tasks around their calendar. The Service includes:

• AI-assisted task scheduling and daily planning
• Google Calendar integration
• Recurring task management
• Optional Pro subscription with expanded AI usage and features

User Accounts

To use DayWise, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your credentials
• All activity that occurs under your account
• Providing accurate registration information

You must be at least 13 years old to create an account. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the Service.

Subscriptions and Payments

Free Plan

DayWise offers a free tier with manual scheduling and core features. No payment information is required for the free plan.

Pro Subscription

DayWise Pro is available as a monthly or annual subscription purchased through the Google Play Store. Subscriptions are managed by Google Play and are subject to Google's billing policies.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can cancel your subscription at any time through your Google Play account settings.
• Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time, except where required by applicable law.

Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price changes via email or in-app notification. Your continued use after the effective date constitutes acceptance of the new pricing.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to scrape, harvest, or extract data from the Service
• Transmit malicious code, viruses, or other harmful content
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity

Intellectual Property

The Service and its original content, features, and functionality are owned by DayWise and are protected by applicable intellectual property laws.

You retain all rights to the content you create within DayWise (your tasks, notes, and scheduling data). By using the Service, you grant us a limited, non-exclusive licence to process your content solely to provide the Service to you.

AI-Generated Content Disclaimer

DayWise uses AI to generate scheduling suggestions. These suggestions are provided as recommendations only. We make no warranty that AI-generated schedules will be optimal, complete, or error-free. You are solely responsible for reviewing and acting on your schedule. DayWise is not liable for missed deadlines, appointments, or obligations arising from your use of the Service.

Third-Party Services

The Service integrates with third-party services including Google Calendar, RevenueCat, and OpenAI. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of these third parties.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall DayWise be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We may suspend or terminate your access to the Service at our sole discretion, without prior notice, if you breach these Terms or if we discontinue the Service.

You may delete your account at any time from within the app (Settings → Account → Delete Account). Deletion is permanent and cannot be undone.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and delete your account.
